1. Introduction

1.1 Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://www.esseconceptstore.co.za/ website (the “Service”) operated by Esse Concept Store (“us”, “we”, or “our”).

1.2 Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1.3 By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1.4 Please also review our Privacy Policy and Cookie Policy, which form a part of these Terms and Conditions and govern your visit to the Site so that you may understand our privacy practices.

2. Order acceptance

2.1 All orders placed by you are subject to our acceptance. We reserve the right at all times and in our sole discretion to refuse to accept an order for any reason and without liability to you.

2.2 Orders may only be placed by individual customers purchasing goods other than for resale. Wholesale customers should contact us directly before placing an order.

2.3 After you have placed the order with us, we will send you an order acknowledgement by email with your order number and details of the product you have ordered. This email is only an acknowledgement of receipt and is not an acceptance of your order. The acceptance of your order and a contract of sale between us will not take place until you have been advised the goods you have ordered are available and these goods have been paid for in full, including any applicable charges. No payment shall be considered to have been received until we have received payment in cleared funds.

3. Your account and order placement

3.1 You may browse our website without registering, but when you place your first order, you will need to register with us and complete certain fields on our order form.

3.2 You should not disclose or transfer your username or password to any other person, and you must notify us immediately if you become aware of any unauthorized use of your username and password. Without prejudice to our rights, we may suspend your access to the website without liability to you if, in our reasonable opinion, such action is necessary to safeguard the website.

3.3 Before you submit your order, you will be given the opportunity to review your selection, check the total price of your order, and correct any errors. Your order represents an offer by you to purchase the items you have selected.

If items shown on our website are not available or are incorrectly priced or incorrectly described, we shall not be obliged to sell you the items as shown.

3.4 We reserve the right to change at any time and without any previous notice the items offered on our website.

3.5 It is vitally important that you carefully check the quantity of goods that you order from us. We will deliver what you order. While you have a right of cancellation, you must pay for the delivery costs back to us.

4. Descriptions and product information

4.1 We have made every effort to represent the colours of our products and their packaging as accurately as possible. However, due to differences in monitors, we are unable to guarantee that the colour you see on your monitor will reflect the true colour of the product and its packaging. If you have any questions about the product, you may, of course, contact us.

4.2 Esse Concept Store warrants that the goods you buy will, at the time of delivery to you, correspond to the description given by Esse Concept Store. Every description or specification of the products we sell is given in good faith.

4.3 Esse Concept Store will pass on to you any benefits obtainable under any warranty provided that you have paid for the goods.

4.4 No statement, description, information, warranty, condition, or recommendation contained in any catalogue, price list, advertisement, or communication made verbally by any employee of Esse Concept Store shall be construed to enlarge, vary, or override in any way any of the provisions of these Terms.

4.5 Except where you buy as a consumer (as defined in Section 12 Unfair Contract Terms Act 1977), all warranties other than those set out above, conditions and terms relating to fitness for purpose, merchantability, or condition of the goods, whether implied by statute or common law or otherwise, are excluded.

4.6 You warrant that, except with the advice of a qualified medical adviser or health professional, you will not purchase any product from us for use by a person (including yourself) who has previously suffered or experienced any reaction or intolerance to any product placed upon the skin.

5. Prices

5.1 All prices on the website are quoted in Rands (R). They include VAT payable but exclude delivery charges, which are detailed separately.

5.2 We may change the prices on the website at any time and without any notice.

5.3 We try to ensure that all prices given on the site are correct. However, mistakes can occur. If we have quoted an incorrect price on the site and if the correct price is lower than that quoted, we will automatically assume that you wish to continue with your order. However, if the correct price is higher than that originally quoted, we will contact you to ask if you still want to order the goods.

6. Payment terms

6.1 You confirm that the credit card/debit card that is being used is yours or that you are authorised to use it. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not accept your order, and we will not be liable for any delay or non-delivery. Furthermore, we are not obliged to inform you of the reason for the refusal. You should note that your bank or card issuer may charge you as a result of our processing your credit/debit card payment in accordance with your order. Esse Concept Store has no responsibility for such charges.

7. Delivery Terms

7.1 All orders placed on esseconceptstore.co.za are delivered by our courier partners (DSV and RAM)

7.2 Delivery Times:

We offer standard delivery on all orders, shipped via our third-party courier partners ( DSV and RAM)

Courier Standard delivery takes 2- 7 working days, depending on your delivery location:

· Main City Centres: 2-5 working days*

· Outlying areas and remote locations: 5- 7 working days.*

*Please note that delivery times stated in 7.2 do not include the processing time to prepare, pack, and ship your order from our warehouse. Orders are typically processed in 24-48 hours, Monday to Friday, excluding public holidays and weekends.

7.3 We cannot guarantee that your order will be dispatched or delivered on any particular date and time.

7.4 Unforeseen circumstances, for example, adverse weather, closed roads, strikes etc. could prolong the delivery time.

7.5 Where there is a delay in the supply of goods, we will advise you as soon as practicable. If the goods cannot be delivered within 30 days of your order, we will notify you of this delay, and you may either cancel your order or agree to a further delivery time with us.

7.6 If your delivery has not been delivered after the estimated times shown above, please contact us with your order number so that we can follow up on the matter.

7.7 Once your order has been shipped, you will receive an SMS or email from our Courier Partner containing a tracking number and link to track your order.

7.8 Delivery Charges:

We offer Free delivery on all orders over R900. We charge a standard delivery fee of R160 for any orders under R900. This fee is automatically applied at checkout.

7.9 Orders will be sent to the delivery address that you have submitted on your order form. We cannot be held responsible if that delivery address is incorrect.

7.10 Please note that we cannot deliver to PO boxes. (There are some delivery restrictions on where we can deliver, and these will be given to you on request.)

7.11 Please note that we can only deliver to physical addresses within South Africa.

7.12 We will deliver the goods following the delivery option selected by you during the order process. Any delivery time scales quoted to you are indicative only. While we use only reputable delivery companies, we do not accept any liability for delayed delivery caused by any third party.

7.13 Successive orders may be joined and delivered in one parcel.

8. Returns and exchanges policy

8.1 We offer a 28-day returns guarantee.

8.2 If you would like to return your products, please contact us at info@esseconceptstore.com within 28 days of receiving your order and provide details on your reason for the return, include a copy of your receipt and order number, your name, email address, phone number, and your reason for returning the product(s). If your return is accepted, we’ll send you instructions on how and where to send your package or provide you with a return shipping label. Items sent back to us without first requesting a return will not be accepted.

8.3 All returned items must be in the same condition you received them, unopened and unused, and in the original packaging.

8.4 If you are returning your product/s because they are not suitable or you have changed your mind, we will refund you the value of the products, less the courier fee, once your refund has been processed and your return has been received at the warehouse in its original condition.

8.5 If you are returning your products due to a fault or problem with the product, please ensure you take any relevant pictures to support your challenge, as well the opened product.

8.6 Please return any opened/ faulty products within 28 days of receiving your product.When returning opened goods, please ensure you seal the product and package it with protective packaging to ensure it is protected during transit.

8.7 Refunds are dealt with on a case-by-case basis and are generally processed within 1- 3 working days by our customer service team.

The Customer service team operating hours are Monday – Friday, from 8am – 4pm

9. Product Expiry Terms:

9.1 Certain Products may contain expiry dates, which will be printed on the Product container.

9.2 All products dispatched from Esse Concept Store will carry a minimum of 4 -6 months remaining to the applicable expiry date, unless specifically stated otherwise during promotional periods.

9.3 Should you receive a product with an expiry date of less than 4 months ( except for promotional products), please inform us immediately and we will arrange for an exchange.

10. Vouchers and Promotional Codes:

10.1 We may offer digital gift vouchers or promotional codes, which You may redeem against Your online purchases.

10.2 All vouchers and promotional codes will be subject to the terms and conditions of that particular voucher or promotional code. Only 1 promotional code or voucher may be used at any one time.

10.3 Vouchers are not transferable and may only be redeemed against Your website purchase, provided that the Voucher is valid and has not expired. Vouchers are not redeemable for cash.

Terms and Conditions for Promotions

These Terms and Conditions (“Terms”) govern all promotions, contests, giveaways, and other promotional activities (collectively, “Promotions”) conducted by Esse Skincare (“we,” “us,” “our”). By participating in any Promotion, participants (“you,” “your”) agree to be bound by these Terms.

1. Promotion Duration and Stock Availability

1.1 Promotions are valid from the start date to the end date specified or while stocks last, whichever occurs first.

1.2 Stock is limited and offered on a first-come, first-served basis.

1.3 Esse Skincare cannot guarantee product availability during the Promotion Period and reserves the right to end the promotion once stock is depleted.

1.4 If stock is exhausted, Esse Skincare is under no obligation to provide alternative products or compensation.

1.5 No rain checks or backorders will be provided for out-of-stock products.

2. Eligibility

2.1 Promotions are open to individuals aged 18 years or older, unless otherwise stated.

2.2 Employees, agents, affiliates, or representatives of Esse Skincare and their immediate family or household members are not eligible.

2.3 Entry is void where prohibited by law.

3. Promotion Period

3.1 Each Promotion begins and ends on the dates specified in the corresponding announcement (“Promotion Period”).

3.2 Entries or purchases made outside the Promotion Period will not be considered.

4. How to Enter

4.1 To enter, follow the instructions outlined in the specific Promotion announcement.

4.2 Entries that are incomplete, fraudulent, or submitted outside the Promotion Period will be disqualified.

4.3 Participants may submit only one entry unless otherwise stated.

5. Prizes or Gifts

5.1 The prize(s) or gift(s) for each Promotion will be described in the specific announcement.

5.2 Prizes or gifts are non-transferable, non-refundable, and cannot be exchanged for cash or other items.

5.3 If the stated prize is unavailable, Esse Skincare reserves the right to substitute it with a prize of equal value.

6. Winner Selection and Notification

6.1 Winner(s) will be selected at random or as otherwise described in the specific Promotion announcement.

6.2 Winner(s) will be notified via the contact information provided upon entry. If a winner cannot be contacted within five (5) business days, Esse Skincare reserves the right to select an alternate winner.

6.3 Proof of identity may be required to claim the prize.

7. Use of Personal Information

7.1 By participating, you agree that your personal information may be used for the purposes of administering the Promotion and as outlined in Esse Skincare’s Privacy Policy.

7.2 You consent to Esse Skincare announcing your name and/or social media handle publicly if selected as a winner, unless prohibited by law.

8. Liability

8.1 Esse Skincare is not responsible for technical, human, or other errors that may arise during the Promotion, including but not limited to lost, late, or misdirected entries.

8.2 By participating, you release Esse Skincare from all liability, loss, or damage arising from your participation or acceptance of any prize.

9. Disqualification

9.1 Esse Skincare reserves the right to disqualify any participant who violates these Terms, uses fraudulent methods, or tampers with the Promotion.

10. Modification or Cancellation

10.1 Esse Skincare reserves the right to modify, suspend, or terminate the Promotion at any time for reasons beyond its control, including but not limited to fraud, technical failures, or unforeseen circumstances.

11. Governing Law

11.1 These Terms are governed by the laws of your country, region, state, or province, and any disputes will be subject to the exclusive jurisdiction of the courts in the specified area.
